Please read these Terms and Conditions carefully before making any booking or engaging with Infinite Safaris Africa. By making a booking, remitting any payment, or participating in a safari or related activity, you (“the Client,” “you,” or “your”) acknowledge that you have read, understood, and unreservedly agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between Infinite Safaris Africa (Pty) Ltd and the Client. If you do not agree with any part of these terms, you must not proceed with a booking or participation in our services.
1. Parties to the Agreement
This agreement is entered into between INFINITE SAFARIS AFRICA (PTY) LTD, a private company duly incorporated under the laws of the Republic of South Africa with company registration number 2019/449340/07, and the Client, being any individual or entity that makes a booking or participates in hunting safari services, accommodation, or related travel arrangements provided by Infinite Safaris Africa. Our primary contact for all queries is henu@infinitesafaris.co.za and +27 83 628 7340.
2. Definitions
For the purpose of these Terms and Conditions, the following definitions shall apply:
3. Booking and Payment Terms
3.1. All safaris are subject to availability and will only be considered confirmed upon the Client’s acceptance of the official Quotation and receipt by Infinite Safaris Africa of the stipulated non-refundable deposit. The precise deposit amount, payment schedule, and any other specific payment conditions will be detailed in the Quotation and must be strictly adhered to by the Client.
3.2. Failure by the Client to pay any required deposits or outstanding balances by their respective due dates may, at the sole discretion of Infinite Safaris Africa, result in the automatic cancellation of the booking without prior notification. In such an event, any deposits or payments already made may be forfeited in full to Infinite Safaris Africa as a cancellation penalty, without prejudice to any other rights or remedies available to Infinite Safaris Africa.
3.3. Safari prices are quoted in United States Dollars (USD) unless explicitly stated otherwise in the Quotation. All prices are subject to change without prior notice due to, but not limited to, fluctuations in international exchange rates, increases in government taxes, conservation fees, concession fees, hunting license costs, or any other unforeseen increases in operational costs. Should such increases occur, Infinite Safaris Africa reserves the right to adjust the Safari price accordingly, and the Client shall be liable for payment of the increased amount.
3.4. The final balance of the safari cost, encompassing all agreed-upon services, estimated trophy fees, and observer daily rates, must be paid in full no later than the date specified in the Quotation, which is typically prior to the commencement of the safari. Any additional costs incurred by the Client during the safari, including but not limited to additional trophy fees for animals hunted or wounded, additional safari days, specific liquor requests, or any damages to property, must be settled in full before the Client’s final departure from the hunting area or lodge.
3.5. All payments made to Infinite Safaris Africa are considered final upon receipt. Any bank charges, foreign exchange fees, or transfer costs associated with the Client’s payments are the sole responsibility of the Client. While Infinite Safaris Africa accepts other currencies for direct payment of safari costs, the national currency of South Africa is the Rand (ZAR), and other currencies may not be used for general payment or purchases outside of direct payments to Infinite Safaris Africa.
3.6. Trophy fees for animals that are successfully hunted or wounded are payable in full upon completion of the safari. An animal is deemed wounded if, in the sole and final determination of the Professional Hunter, it has been hit by a shot and is not recovered. Such wounded animals will be charged as if hunted. A detailed schedule for trophy fees is provided in the Quotation and is subject to revision based on market conditions or changes in regulations.
4. Cancellation Policy
4.1. All safari cancellations must be submitted by the Client to Infinite Safaris Africa in writing via email. The date upon which the written cancellation is received by Infinite Safaris Africa will be considered the effective date of cancellation for the purpose of calculating cancellation fees.
4.2. Cancellation fees will be applied as follows, calculated based on the total safari cost:
4.3. Any refunds due to the Client following the application of cancellation fees will be processed within a reasonable timeframe after the effective date of cancellation, following the deduction of any unrecoverable costs incurred by Infinite Safaris Africa related to the booking.
4.4. Infinite Safaris Africa strongly recommends that all Clients obtain comprehensive travel insurance, including specific cancellation insurance, immediately upon booking their safari. Such insurance should cover unforeseen circumstances that may necessitate cancellation by the Client, including but not limited to medical emergencies, family emergencies, or travel disruptions.
4.5. In the event that Infinite Safaris Africa is compelled to cancel or significantly alter a safari due to Force Majeure, we will endeavor to reschedule the safari to a mutually agreeable later date. If rescheduling is not possible, Infinite Safaris Africa may, at its sole discretion, offer a credit for future use equal to the amounts paid, valid for a specified period. Infinite Safaris Africa shall not be held liable for any additional costs incurred by the Client (e.g., international or domestic flights, alternative accommodation, visa fees, loss of earnings) due to such cancellation, rescheduling, or alteration caused by Force Majeure.
5. Client Responsibilities and Safari Conduct
5.1. The Client assumes full responsibility for their safety and well-being throughout the duration of the safari. The Client acknowledges that participating in a hunting safari involves inherent dangers and risks, including but not limited to direct encounters with dangerous wild animals, the handling and discharge of firearms, travel over rough and unpredictable terrain, exposure to unpredictable weather conditions, and the remote nature of certain operating areas. The Client freely and voluntarily accepts and assumes all such risks associated with their participation in the safari.
5.2. The Client must strictly adhere to all instructions, decisions, and safety protocols issued by the Professional Hunter and any Infinite Safaris Africa staff. The Professional Hunter’s decisions regarding hunting activities, shot selection, animal identification, ethical conduct, and the overall safety and well-being of the safari party are absolute, final, and binding. Any failure by the Client to comply with these instructions, or any engagement in unsafe, illegal, or unethical conduct, will result in the immediate termination of the safari without any refund, and the Client may be required to leave the hunting area immediately.
5.3. All hunting activities will be conducted exclusively under the direct supervision of a licensed Professional Hunter and in strict accordance with the principles of fair chase, as well as all applicable local and international laws and regulations of the country where the safari takes place. The Client is expected to hunt ethically and responsibly at all times, demonstrating respect for wildlife and the environment.
5.4. The Client is solely responsible for any damage caused to Infinite Safaris Africa’s property, vehicles, equipment, or any third-party property during the safari, whether such damage is caused intentionally, by negligence, or through recklessness. The cost of such damages must be settled by the Client in full before their departure from the safari area.
5.5. Infinite Safaris Africa reserves the right to decline or terminate a safari for any individual at any time if, in the sole discretion of the Professional Hunter or Infinite Safaris Africa management, the Client’s conduct poses a danger to themselves or others, interferes with the proper conduct of the safari, or violates any laws or these Terms and Conditions.
6. Health, Medical Information, and Insurance
6.1. The Client must be in good physical and mental health suitable for participating in a hunting safari, which often involves strenuous activity, prolonged periods in the field, and exposure to varying environmental conditions. Any pre-existing medical conditions, allergies, special dietary requirements, or physical limitations must be fully disclosed to Infinite Safaris Africa in writing at least 30 days prior to the safari commencement date to allow for necessary preparations and accommodations. Infinite Safaris Africa will make reasonable efforts to accommodate disclosed needs but cannot guarantee the availability of all specialized items or services, particularly in remote areas.
6.2. While there are no stipulated immunization or medication requirements for travel to South Africa, Infinite Safaris Africa strongly advises the Client to consult with their medical doctor or a travel health specialist well in advance of travel. This consultation should determine if there are any necessary precautions, immunizations, prophylactic medications (e.g., anti-malarials), or emergency medications the Client should take or carry for travel to and participation in activities within the safari region. Infinite Safaris Africa is not qualified to provide medical advice.
6.3. It is a mandatory requirement for the Client to obtain and maintain comprehensive travel and medical insurance for the entire duration of the safari. This insurance must specifically cover hunting activities, emergency medical treatment, hospitalization, emergency medical evacuation (including air ambulance services from remote areas), repatriation in the event of serious injury or death, personal liability, and safari cancellation or interruption. Infinite Safaris Africa shall under no circumstances be responsible for any medical expenses incurred by the Client during the safari, nor for any costs associated with medical emergencies, evacuation, or repatriation. The Client acknowledges that emergency medical services and evacuation capabilities may be limited or delayed in remote safari areas.
7. Firearms, Ammunition, and Import Permits
7.1. Clients intending to bring their own firearms for hunting must strictly comply with all relevant international and domestic laws, regulations, and import procedures pertaining to firearm ownership, transportation, and temporary import into the safari country. Infinite Safaris Africa will assist with the pre-arrangement of necessary temporary firearm import permits by collecting required information (such as firearm make, model, serial number, caliber, and exact ammunition quantity) from the Client well in advance of their arrival. However, the ultimate and sole responsibility for obtaining, possessing, and ensuring the validity of all required permits and documentation rests entirely with the Client.
7.2. The exact quantity of ammunition stated in advance for permit applications must be the precise quantity the Client travels with. Any changes to ammunition quantity must be communicated to Infinite Safaris Africa immediately and may require permit amendments, for which the Client is solely responsible.
7.3. Upon arrival at Kimberley Airport, a representative from Infinite Safaris Africa will meet the Client at baggage claim and provide assistance with luggage and the official clearing and collection of firearms with local authorities. Please note that an additional fee of $30 USD or R300 ZAR is applicable for the handling of rifles on arrival and departure from Kimberley Airport. This fee is not included in the standard safari package.
7.4. Infinite Safaris Africa accepts no responsibility for any delays, loss, damage, confiscation, or refusal of entry of firearms or ammunition by customs, airline carriers, or any other government authorities, whether such events are due to administrative oversight, non-compliance by the Client, or any other reason beyond the reasonable control of Infinite Safaris Africa. Any and all costs, charges, or losses incurred by the Client as a result of such events are the Client’s sole responsibility.
7.5. Clients choosing to rent firearms from Infinite Safaris Africa must adhere to all safety instructions provided by the Professional Hunter and assume full responsibility for the proper, safe, and ethical handling and use of the rented firearm throughout the safari. Any damage to rented firearms beyond normal wear and tear will be charged to the Client.
8. Permits, Licenses, and Legal Compliance
8.1. All hunting activities conducted by Infinite Safaris Africa are undertaken only under valid government-issued hunting licenses and permits, which are obtained by Infinite Safaris Africa on behalf of the Client. The cost of these necessary permits and licenses is typically included in the overall safari package or is listed as a separate, mandatory fee in the official Quotation provided to the Client.
8.2. The Client is solely responsible for ensuring they possess all necessary personal travel documents, including a valid passport that has sufficient remaining validity (typically at least six months beyond the planned departure date from the safari country), and any required visas for entry into the primary safari country (e.g., South Africa, Namibia, Zambia, Botswana, Mozambique, Zimbabwe, Tanzania) and any transit countries. While Infinite Safaris Africa may provide general guidance on visa requirements, it is the Client’s ultimate responsibility to consult with their travel consultant or the relevant embassy/consulate of the safari country and any transit countries to obtain the correct and valid documentation. Infinite Safaris Africa shall not be held liable for any costs, losses, or inconveniences (including safari cancellation or interruption) incurred due to the Client’s failure to obtain proper and timely travel documentation.
8.3. The Client must strictly adhere to and comply with all applicable laws and regulations of the safari country at all times. This includes, but is not limited to, national and provincial wildlife conservation laws, firearms laws, immigration laws, customs regulations, traffic laws, and any local ordinances. Any breach of these laws or regulations by the Client, regardless of intent, will result in the immediate termination of the safari, forfeiture of all safari fees paid, and potential legal prosecution by local authorities. Infinite Safaris Africa will cooperate fully with law enforcement agencies in such instances and reserves the right to report any such breaches.
9. Trophy Handling and Shipment
9.1. Infinite Safaris Africa will arrange for the basic field preparation of trophies (including skinning, initial cleaning, and salting of skins) in accordance with standard industry practices. This essential field preparation service is included in the safari package.
9.2. All subsequent costs related to the further processing, dipping, packing, governmental inspections, obtaining necessary CITES export permits (where applicable), and the eventual shipment of trophies from the safari country to the Client’s home country or a designated international taxidermist are explicitly excluded from the safari price. These costs are the sole responsibility of the Client and must be settled directly with the relevant third-party service providers (e.g., dipping and shipping agents, taxidermists).
9.3. Infinite Safaris Africa will facilitate arrangements with reputable and licensed third-party service providers for dipping, packing, and shipping services on the Client’s behalf, based on the Client’s explicit instructions. However, Infinite Safaris Africa shall not be held liable for the services, charges, delays, or any damage, loss, or confiscation of trophies occurring during the handling, processing, or transit by these third-party providers or by customs/veterinary authorities.
9.4. The Client must provide Infinite Safaris Africa with clear, complete, and accurate instructions regarding their chosen dipping/shipping agent and/or taxidermist prior to the conclusion of the safari. It is the Client’s sole responsibility to understand and comply with all import regulations, permit requirements (including CITES import permits), and any veterinary or quarantine requirements in their home country for the legal importation of hunting trophies. Infinite Safaris Africa will provide assistance with documentation required for export from the safari country but bears no responsibility for the Client’s ability to import trophies into their own country.
9.5. Should any trophy be subject to confiscation, unforeseen delays, damage, or destruction by customs, veterinary services, or any other governmental authority, either in the safari country or the Client’s home country, due to the Client’s failure to comply with regulations or for any other reason beyond the control of Infinite Safaris Africa, the Client assumes all associated costs, risks, and losses.
10. Limitations of Liability and Indemnification
10.1. The Client hereby acknowledges that hunting and related activities conducted in natural wildlife areas inherently involve significant dangers and risks. These risks include, but are not limited to, the presence and unpredictable behavior of dangerous wild animals, the use and discharge of firearms, travel over rough and unpredictable terrain, exposure to varying and sometimes extreme weather conditions, the possibility of accidents, serious bodily injury, illness, disease (including but not limited to the contraction of any communicable disease), and death. The Client freely, voluntarily, and knowingly accepts and assumes all such risks associated with their participation in the safari.
10.2. Infinite Safaris Africa (Pty) Ltd, its owners, directors, officers, employees, professional hunters, agents, contractors, and representatives (collectively, “the Released Parties”) shall not be held liable for any death, injury, bodily harm, illness, loss, damage to personal property (including money, valuables, firearms, or equipment), or any other loss suffered by the Client or any member of their party whilst on the premises of any areas in which Infinite Safaris Africa operates, transports the Client to, or engages in any activities arranged by Infinite Safaris Africa. This waiver of liability extends to any such occurrences arising directly or indirectly from the negligence of the Released Parties or from any other cause whatsoever, including but not limited to acts of God, natural disasters, unforeseen circumstances, or force majeure events.
10.3. The Client understands and acknowledges that usage and transport on any vehicles (including ground vehicles) and/or aircrafts (including fixed-wing aircraft and helicopters) operated by Infinite Safaris Africa or its contractors are undertaken by the Client at their own sole risk. The Client acknowledges that while Infinite Safaris Africa strives for safety, the insurance passenger liability on aircrafts may be limited to R 2.5 million per seat and R 5.5 million on helicopters, which are operated and owned by Infinite Safaris Africa Trust. The Client accepts these stated liability limits.
10.4. The Client agrees to indemnify, defend, and hold harmless Infinite Safaris Africa and the Released Parties from and against any and all claims, demands, actions, causes of action, liabilities, losses, damages, expenses, or costs (including reasonable legal fees) that may arise from or in connection with the Client’s participation in the safari, including but not limited to claims for personal injury, death, property damage, or any other loss, regardless of the cause.
10.5. Infinite Safaris Africa accepts no responsibility for any loss, damage, or theft of the Client’s personal belongings, money, or valuables. Clients are expressly advised to secure their personal belongings at all times and to carry only essential items into the field.
10.6. In the event of unpredictable travel circumstances, such as last-minute changes to flights or other program elements, Clients are advised to contact Infinite Safaris Africa directly. Infinite Safaris Africa shall not be liable for any additional costs incurred by the Client due to such unpredictable travel circumstances or changes beyond its control.
11. Marketing and Publicity
11.1. The Client hereby grants Infinite Safaris Africa the irrevocable right and permission to use, publish, display, and reproduce any photographs, video footage, or other media taken of the Client during the safari without further notification, payment, or consideration. This media may be used by Infinite Safaris Africa on its official websites (www.infinitesafaris.co.za, www.infinitesafarishunting.com or any future domain), social media platforms, brochures, promotional materials, or any other advertising or publicity purposes. This consent is deemed given upon the Client’s booking and participation in the safari.
12. Governing Law and Jurisdiction
12.1. These Terms and Conditions, and any agreement between Infinite Safaris Africa and the Client arising from these terms, shall be governed by and construed exclusively in accordance with the laws of the Republic of South Africa, without regard to its conflict of laws principles.
12.2. Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions or the safari, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the Republic of South Africa. By entering into this agreement, the Client irrevocably submits to the exclusive jurisdiction of the South African courts.
13. Severability
13.1. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity or enforceability of any other provision herein. The remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if such modification is not possible, the provision shall be severed from this agreement, and the remainder of the agreement shall continue in full force and effect.
14. Entire Agreement
14.1. These Terms and Conditions, together with the Client’s confirmed Quotation and Booking Confirmation, constitute the entire agreement between the Client and Infinite Safaris Africa (Pty) Ltd regarding the safari services. This agreement supersedes all prior or contemporaneous discussions, communications, understandings, or agreements, whether oral or written, between the parties relating to the subject matter hereof.
15. Amendments
15.1. Infinite Safaris Africa reserves the right to amend, modify, or update these Terms and Conditions at any time. Any changes will be effective immediately upon being posted on our official website. It is the Client’s responsibility to review these Terms and Conditions periodically for any changes. The Client’s continued use of our services or website after such changes constitutes their acceptance of the new Terms and Conditions.
